Terms of Service

You must be 18 years of age or older to create an account or use Marchh.

By creating an account, you represent that you are at least 18 years old and are legally capable of agreeing to these Terms.

Marchh may use the date of birth supplied during onboarding to determine age eligibility.

Providing false age information may result in restriction or termination of your account.

Competitive Territory and all other competitive territory functionality are also restricted to people aged 18 or older.

You are responsible for maintaining the security of your Marchh account and for activity performed through your account.

Marchh may support authentication through Apple, Google, email, or other methods made available in the application.

You must not access another person's account without authorization, impersonate another person, create accounts for fraudulent or abusive purposes, or attempt to circumvent Marchh's authentication or security systems.

You are responsible for keeping information associated with your account reasonably accurate.

Marchh is a movement-based digital experience that uses walking, running, maps, location data, and virtual territory mechanics.

Marchh may use your movement and device-location information to calculate routes, distance, pace, covered areas, virtual territory geometry, and other activity information.

Some Marchh features allow users to interact socially and publish content.

GPS and other location technologies are not perfectly accurate.

Location measurements may be affected by device hardware, buildings, trees, terrain, weather, network availability, operating-system behaviour, satellite visibility, signal interference, and other factors outside Marchh's control.

Marchh does not guarantee the accuracy of a route, coordinate, pace, distance, covered area, territory boundary, map position, or other geographic measurement.

Marchh may reject or adjust activity information that fails technical integrity checks.

Marchh territories are entirely virtual.

A Marchh territory does not create ownership, possession, tenancy, authority, access permission, land rights, intellectual-property rights in a real location, or any other legal right over physical property.

A territory appearing on a Marchh map does not give you permission to enter that place.

Territory ownership may change according to Marchh's rules and product functionality.

Marchh does not guarantee that a user will retain a territory indefinitely.

Your safety and the safety of people around you must take priority over Marchh.

Do not trespass, enter private property without permission, enter restricted locations, walk onto dangerous roads or railway tracks, ignore traffic rules, enter unsafe environments, or otherwise put yourself or another person in danger to create or claim territory.

Pay attention to traffic, terrain, weather, vehicles, people, property boundaries, animals, and your surroundings while using Marchh.

Do not interact with Marchh while driving or operating machinery.

Marchh is not an emergency, rescue, navigation, medical, or safety service.

You remain responsible for deciding whether a location, route, or activity is safe and lawful.

An activity does not automatically guarantee a successful territory claim.

Marchh may apply rules relating to GPS accuracy, route integrity, movement, covered area, geometry, territory conflicts, minimum activity requirements, or other integrity criteria.

Marchh may reject movement or territory information that appears technically invalid, corrupted, duplicated, manipulated, artificial, or inconsistent with Marchh's territory rules.

Territory outcomes may also change as Marchh's systems resolve overlapping or conflicting claims.

You must not manipulate Marchh to obtain activity results or territory unfairly.

This includes GPS spoofing, fake-location tools, fabricated routes, automated movement, device manipulation, emulator abuse where used to falsify activity, exploiting bugs, coordinated fake accounts, duplicated activities, or other attempts to make Marchh believe movement occurred when it did not.

Marchh may reject affected activities, remove or release affected territory, restrict functionality, suspend accounts, or take other reasonable action when deliberate abuse is detected.

Marchh may allow you to create or publish content such as profile information, usernames, captions, comments, activity shares, and other material.

You retain ownership of content that you create.

By submitting or publishing content to Marchh, you grant Marchh a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, transmit, technically process, and moderate that content as reasonably necessary to provide, secure, operate, and improve Marchh.

This license does not transfer ownership of your content to Marchh.

You represent that you have the rights necessary to publish the content you submit.

Your use of Social and other interactive Marchh features must comply with the Marchh Community Guidelines:

The Community Guidelines form part of these Terms.

Where supported, Marchh allows users to report content or accounts and block other users.

We may review reports and take action where reasonably necessary to protect users, enforce these Terms or the Community Guidelines, prevent abuse, or comply with law.

Action may include removing content, restricting visibility, limiting functionality, restricting interactions, releasing territory obtained through abuse, suspending an account, or terminating an account.

Blocking may affect Social visibility and interactions, but certain territory information may remain visible because territory ownership is part of Marchh's shared map experience.

You may not use Marchh to harass, threaten, bully, stalk, intimidate, exploit, deceive, defraud, impersonate, or harm another person.

You may not publish unlawful content, serious threats, exploitative sexual content, content that violates another person's privacy, or content that infringes intellectual-property rights.

You may not expose another person's sensitive private information without authorization.

You may not use Marchh for spam, phishing, scams, malware distribution, unauthorized commercial scraping, automated account abuse, security attacks, unauthorized access, service disruption, or other malicious activity.

You may not encourage trespassing or dangerous behaviour for the purpose of obtaining Marchh territory.

Marchh's software, branding, logos, visual identity, interface, original designs, written material, and other proprietary elements are owned or controlled by the operator of Marchh or its applicable licensors and are protected by applicable intellectual-property laws.

These Terms do not transfer ownership of Marchh's intellectual property to you.

You may not copy, reproduce, sell, redistribute, impersonate, or commercially exploit Marchh's protected materials except where expressly authorized or permitted by law.

Marchh depends on third-party services including authentication providers, mapping and geographic-data systems, backend infrastructure, operating-system functionality, network providers, and hosting services.

Third-party services may be governed by their own terms and privacy policies.

Marchh cannot guarantee uninterrupted availability or performance of services that are outside our reasonable control.

We may modify, improve, suspend, replace, limit, or discontinue Marchh functionality.

Features may differ by operating system, location, account status, app version, device, or technical availability.

We do not guarantee that every Marchh feature will remain available permanently.

We may restrict, suspend, or terminate access where reasonably necessary because of serious or repeated violations of these Terms or the Community Guidelines, fraud, security threats, manipulation of Marchh systems, abuse of other users, unlawful conduct, or legal obligations.

Where appropriate and reasonably possible, we may provide information about the reason for action taken.

Serious safety, fraud, security, or legal violations may result in immediate action.

You may initiate permanent account deletion from:

Marchh may require confirmation or reauthentication before completing deletion.

Deleting an account may result in the permanent loss of profile data, activity information, Social relationships, content, territory ownership, and other account-associated information.

Deletion may not be reversible.

If Sign in with Apple is associated with your account, Marchh may request Apple authentication during deletion in order to revoke the associated Apple authorization.

If you voluntarily send ideas, comments, suggestions, or other feedback about Marchh, you permit us to use that feedback to improve Marchh without an obligation to compensate you.

This does not transfer ownership of unrelated intellectual property that you already own.

Marchh is provided on an “as available” basis to the extent permitted by applicable law.

We do not guarantee uninterrupted service, perfect GPS accuracy, error-free territory calculation, permanent territory ownership, uninterrupted third-party infrastructure, or that every feature will always work on every device or in every location.

Nothing in these Terms excludes warranties, remedies, consumer rights, or other protections that cannot lawfully be excluded.

To the maximum extent permitted by applicable law, Marchh and its operator will not be liable for indirect, incidental, special, exemplary, consequential, or similar losses resulting from use of or inability to use Marchh where such liability may lawfully be limited.

You remain responsible for your physical safety, your route choices, your compliance with applicable law, and your conduct while using Marchh.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

To the extent permitted by applicable law, you agree to be responsible for claims, losses, or costs resulting from your unlawful use of Marchh, your material violation of these Terms, or your infringement of another person's rights.

This provision applies only to the extent enforceable under applicable law.

These Terms are governed by the laws of India, without limiting mandatory consumer, privacy, or statutory rights that apply to you under the laws of your place of residence.

Disputes will be subject to the jurisdiction of courts having lawful jurisdiction under applicable Indian law.

Nothing in these Terms is intended to exclude or restrict rights that cannot lawfully be excluded or restricted.

We may update these Terms as Marchh changes, new functionality is introduced, or legal requirements change.

If a change is material, we may provide reasonable notice through Marchh, the website, or another appropriate method.

Continued use of Marchh after updated Terms become effective constitutes acceptance where permitted by applicable law.
